“All discrimination against unvaccinated people must be lifted immediately – they are simply unconstitutional.” This is the conclusion of the Freiburg constitutional lawyer Professor Dr. Dietrich Murswiek in a comprehensive legal opinion . This was commissioned by the “ Initiative Freie Impfentscheid eV ”.
Murswiek’s report comprises an impressive 111 pages, in which he devotes himself in detail to the violations of fundamental rights against unvaccinated persons and examines their constitutional basis. The conclusion is clear: the discriminatory and exclusive measures from 3G, 2G to 1G are unlawful across the board.
Murswiek explains:
The restrictions on freedom are illegal because they presuppose the existence of an epidemic of national importance. This situation was determined by the Bundestag, so that the determination is fulfilled as a formal requirement. Measures according to § 28a IfSG may only be taken if the material criteria of an epidemic situation of national scope are also met. This is not the case.
The restrictions on freedom for unvaccinated people are completely incompatible with the principle of proportionality . There is no threat of overloading the health system at all – and the emergence of such a danger could be counteracted by other means that do not restrict people’s freedom. The state can, for example, expand the health system – but it is not entitled to restrict people’s freedoms in order to minimize risks that are below the level of generally accepted general life risks. This is especially true if the discriminated person does not cause these risks.

Insofar as the state wants to justify the 2G and 3G rules by stating that they serve to minimize the severity of the course of illness and death, it is not a matter of averting danger, but of optimizing health protection in the sense of risk prevention below the risk threshold. In order to combat risks that are not significantly greater than the general risks to life, which have always been accepted and have never led the state to intervene by restricting freedom for the general public, the freedom of people who are not responsible for these risks must not be restricted are responsible.With 2G and 3G, however, the state is restricting the freedom of “non-disruptors”, people who are not infectious and therefore not responsible for the risk of infection. According to the Basic Law, freedom is guaranteed to the individual by virtue of his or her human dignity. He does not only receive it from the authorities if he can prove that he meets the criteria defined by the state for his harmlessness.
According to the constitutional lawyer, different treatment of vaccinated and unvaccinated people is only justified with the aim of containing an epidemic if a vaccination reliably guarantees sterile immunity . It has been proven that this is not the case with the Covid-19 vaccine. Vaccinated people become infected and infect other people.
Vaccination pressure
According to Murswiek, the vaccination pressure caused by the discrimination against unvaccinated persons is an “interference with the right to self-determination about physical integrity (Art. 2 Paragraph 2 Sentence 1 in conjunction with 1 Paragraph 1 GG or Art. 2 Paragraph 1 in conjunction with 1 Paragraph 1 GG) and as an encroachment on the right to life and physical integrity (Article 2, Paragraph 2, Sentence 1 of the Basic Law) ”. For the individual, this encroachment on physical integrity is unreasonable, especially in view of the serious health risks associated with it. The risks of vaccination are rated by the Federal Government, the Paul Ehrlich Institute and the European Medicines Agency (EMA) as significantly lower than the risks of infection with SARS-CoV-2. In this context, however, this is irrelevant, because each individual decides on the basis of his or her autonomy which risks he wants to expose himself to and how he evaluates these risks. If you personally – because you consider your immune system to be healthy and stable and have no previous illnesses – the risks of the possible side effects of the vaccination are much greater than the possible advantages of the vaccination,can be put into an unbearable psychological predicament by the indirect compulsory vaccination.
In this context, Murswiek also points out the completely unclear long-term consequences of the vaccine.
Compulsory vaccination unnecessary, the rights of the unvaccinated weigh more heavily
The constitutional lawyer states that there cannot be herd immunity caused by vaccination due to the ineffectiveness of the vaccination. If one believes the data that indicate a lower level of further transmission of the virus by newly vaccinated people, the sense of increasing the vaccination rate can still be affirmed – however, indirect compulsory vaccination cannot be justified:
The indirect compulsory vaccination is not necessary for individual protection. Because today every individual can protect themselves against SARS-CoV-2 infections by voluntarily getting vaccinated. Restrictions on freedom for uninfected people to protect the general public are therefore no longer necessary. Those who want to protect themselves through vaccination protect themselves, and those who do not want to be vaccinated accept the risks that they could avoid through the vaccination. The requirement is therefore reduced to the protection of the group of people who cannot be vaccinated for medical reasons. However, if they fear the risks of a SARS-CoV-2 infection, this group of people can protect themselves from the infection by means other than a vaccination. and the state could – if necessary – provide help for this.
When weighed up, the rights of the unvaccinated to self-determination as well as to life and physical integrity have greater weight than the protection of other people, whose COVID-19 risk is no greater than other risks to which all people are exposed, without the state with restrictions on freedom for other people who did not cause these risks intervened.
Murswiek has thus dismantled the entire argumentation of politics – and comes to the conclusion:

What’s more, we already have evidence showing the shots don’t work as advertised. They lose effectiveness very rapidly. The answer we’re given is booster shots.
Israel is already talking about a fourth dose, and the injections have not even been out for a full year yet.
The reason we keep getting more variants is because the vaccine is “leaky.” It doesn’t prevent you from getting infected, so the virus starts to mutate to evade the vaccine-induced antibody.
Carvallo agrees, adding that it’s equally insane that the shots are designed to produce antibodies against just one portion of the virus, the spike protein, rather than act against the pathogenesis of the virus.
When you recover from a natural infection, you have both humoral and cellular immunity, and even though humoral immunity (antibodies) will decrease within a few months, you still have latent cellular immunity that will spring into action when needed.
The COVID shots do not provide any cellular immunity, which is why they cannot achieve herd immunity, even if 100% of a population is injected.
Carvallo also points out that the SARS-CoV-2 virus is now the weakest it’s ever been. The real enemy at this point is the propaganda that keeps fear alive.
